What Happens If My Teen Gets Arrested?

Understanding the Juvenile Justice Process in Pennsylvania

If your child has been arrested, you’re likely feeling overwhelmed, scared, and unsure of what comes next. The juvenile justice system in Pennsylvania works differently from the adult system, and knowing what to expect can make a big difference in how you respond and advocate for your teen.

1. Your Child Is Taken Into Custody

After an arrest, your teen may be taken to a police station or juvenile detention center. In many cases, depending on the severity of the charge and your child’s record, they may be released to your custody with a notice to appear in court. If not, a detention hearing will usually be held within 72 hours to determine whether they will remain in custody.

2. You’ll Be Notified Quickly

Pennsylvania law requires that parents or guardians be notified when a minor is taken into custody. You’ll be told where your child is being held and when any hearings will take place.

3. Detention Hearings Determine the Immediate Future

At the detention hearing, a judge will decide whether your teen can go home or must remain in a juvenile facility while the case proceeds. Judges consider factors like the nature of the charges, your teen’s history, and whether they’re a flight risk or danger to others.

4. The Juvenile Petition

Instead of a criminal complaint like in adult court, a juvenile petition outlines the alleged offense. The case then proceeds through the juvenile court system. Some offenses may result in informal supervision or diversion programs, while others may go to formal adjudication (trial).

5. Adjudication and Disposition

If the case goes to adjudication, a judge will determine whether your child committed the offense. There is no jury in juvenile court. If the judge finds them responsible, a disposition hearing will be held to decide the consequences, which can range from probation to placement in a residential facility.

6. Focus on Rehabilitation

Unlike adult court, the juvenile system emphasizes rehabilitation over punishment. Judges may order counseling, community service, or educational programs to help your teen get back on track. The goal is to prevent future offenses while protecting the community.

7. Your Role as a Parent

You play an important role in the process. Showing up to hearings, cooperating with probation officers, and helping your teen follow through with court-ordered conditions can positively influence outcomes.

Why Legal Representation Matters

Even though juvenile cases are different from adult criminal cases, they are still serious. A juvenile record can affect your child’s future educational, employment, and housing opportunities. An experienced juvenile defense attorney can protect your teen’s rights, negotiate favorable outcomes, and keep the focus on rehabilitation.
